TERMS OF SERVICE

IN SUMMARY

Glot distinguishes two types of users: organisers (clients who deploy the service) and participants (who access the session). These Terms apply to both. Glot is a comprehension aid tool, its automatic translations do not constitute certified information and should not be used as the basis for critical decisions. Glot's liability is capped at the amount paid for the session in question.

1. Service Description

Glot is a real-time translation and captioning service for professional events, accessible via web browser at getglot.com. The service is published by Glot, reachable at contact@getglot.com.

Glot is offered in its initial version to selected early adopters. Certain features may evolve, be enhanced or modified based on usage feedback.

2. Definitions and Roles

The Organiser

The organiser is the individual or legal entity who subscribes to a Glot session, deploys the service in the context of an event and shares access with participants. The organiser is Glot's direct client. They act as data controller under the GDPR for the data of their event's participants, and Glot acts as data processor on their behalf.

The Participant

The participant is any person who accesses a Glot session via a link provided by an organiser. The participant uses the service personally to follow the translation or captioning of an event they are legitimately attending. These Terms are binding on them upon accessing the session.

3. Acceptance of Terms

Access to and use of the Glot service implies full and unconditional acceptance of these Terms of Service. For the organiser, this acceptance occurs upon subscribing to a session. For the participant, it occurs upon selecting a language and accessing the session.

If you do not accept these Terms, you must immediately cease using the service.

4. Organiser Responsibilities

The organiser is solely responsible for the audio content broadcast during the event for which they deploy Glot. They declare and warrant that they hold all necessary rights over the content broadcast, including broadcasting, reproduction and translation rights for the presentations. They undertake to inform speakers and participants of the use of an automatic translation and captioning service.

The organiser undertakes not to use Glot to broadcast unlawful content, content infringing third-party rights, content contrary to public order or morality. In the event of a breach of these obligations, the organiser shall bear sole legal, financial and reputational consequences, and shall indemnify Glot against any third-party claims in this regard.

5. Acceptable Use

Permitted uses

The Glot service is intended to facilitate real-time comprehension of professional events. Each user may access the translation or captioning of the session for which they have received legitimate access and share feedback at contact@getglot.com.

Prohibited uses

It is prohibited to use Glot for medical, legal, judicial or any other purposes where an inaccurate translation could entail liability or form the basis of a critical decision. Automatically produced translations do not constitute certified information and cannot substitute for the intervention of a qualified professional.

It is also prohibited to attempt to circumvent the service's security measures, to access sessions for which no access has been granted, to use the service for illegal, fraudulent or public order-contrary purposes, to collect data on other participants or to reverse-engineer Glot's technology.

Recording content

Any recording of audio or textual content produced by Glot is subject to the prior written authorisation of the event organiser, in accordance with the rules defined by the organiser for their event. Glot cannot technically control recordings made by participants and accepts no liability in this regard. Liability for an unauthorised recording rests solely with its author.

6. Intellectual Property

Glot and all its components, technology, algorithms, interface, brand, domain name, design and documentation, are the exclusive property of Glot and are protected by applicable intellectual property laws. Access to the service confers no ownership rights over these elements. Any reproduction, modification, adaptation or exploitation without Glot's express written authorisation is strictly prohibited.

The content of events broadcast via Glot remains the property of their respective authors. Glot claims no rights over this content and retains no record of it after the end of the session.

7. Limitation of Liability

Automatic nature of the service

Glot is a comprehension aid tool using real-time automatic translation and captioning. Translations produced are automatically generated and may contain inaccuracies, particularly in the presence of strong accents, technical terms, proper nouns or difficult sound environments. Glot does not warrant the accuracy, completeness or suitability of translations for a specific use.

Dependence on third-party services

Glot's operation relies on third-party infrastructure and services, including cloud services and artificial intelligence services. Glot does not guarantee perfect real-time service continuity and shall not be liable for interruptions, degradations or unavailability attributable to these third-party services, to the quality of the user's internet connection or to external causes beyond its control.

Liability cap

To the extent permitted by applicable law, Glot's total liability under these Terms, for all types of loss combined, is capped at the amount actually paid by the organiser for the session in question. Glot shall under no circumstances be liable for indirect, consequential, intangible losses or loss of business, regardless of cause and legal basis.

Early adopter access

As an early adopter, you access Glot in its initial version, provided as-is and in continuous improvement. This limitation is inherent to the nature of your preferential access and constitutes an essential condition of your participation in this adoption phase.

8. Suspension and Termination

Glot reserves the right to suspend or terminate access to the service, immediately and without notice, in the following cases: non-compliance with these Terms, fraudulent or abusive use of the service, broadcast of unlawful content, infringement of third-party rights, or endangering the security of the infrastructure.

In the event of suspension for technical reasons or planned maintenance, Glot will endeavour to inform the organiser within a reasonable timeframe. Suspension or termination of the service does not give rise to any compensation, except in the event of proven exclusive fault on the part of Glot.

The organiser may terminate their access at any time by ceasing to use the service and contacting Glot at contact@getglot.com.

9. Personal Data

The processing of personal data in connection with the use of the service is described in Glot's Privacy Policy, available at getglot.com/privacy. This policy forms an integral part of these Terms.

10. Modification of Terms

Glot reserves the right to modify these Terms at any time. The date at the top indicates the version in force. In the event of a material change, the organiser will be informed by email before the new Terms take effect. Continued use of the service after notification constitutes acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute regarding their interpretation or performance, the parties undertake to seek an amicable solution before any legal proceedings. Failing agreement within 30 days, the dispute shall be submitted to the competent courts of the Paris jurisdiction.
